Terms and conditions donations

Here you can read the general terms and conditions that apply to donating to the Stichting Student’s International Meditation Society Nederland foundation.
You donate to the non-profit foundation Stichting Student’s International Meditation Society Nederland, located in Vlodrop under Chamber of Commerce number 41203764 and designated as a Algemeen Nut Beogende Instelling (ANBI).

Article 1 – Definitions

Donor: Person or organization who can support the foundation by using tmcentrum.nl, with or without a reward.
Donation: an amount of money donated by the donor. This is a financial transaction via a PSP (payment service provider) in which a donor decides to donate a certain amount of money to tmcentrum.nl, knowing that this donation is entirely voluntary.
Target Amount: The predetermined target amount of donations for the campaign;
Campaign: The campaign placed on the website by the foundation, for which donations will be raised for the realization of the TM Center during the now established term of 30 days, from Saturday 22 May 2021;
Foundation: the natural or legal person who remotely offers the product to donors;
Reflection period: the period within which the donor can make use of his right of withdrawal;
Right of withdrawal: the donor’s option to cancel the distance contract within the cooling-off period
Remote agreement: an agreement that is digitally concluded between the foundation and the donor in the context of the web shop/ website, whereby up to and including the conclusion of the agreement, only or partly use is made of one or more techniques for distance communication;
Day: calendar day.

Article 3 – Applicability
These general terms and conditions apply to any offer from the foundation and to any distance contract concluded between the foundation and the donor. These general terms and conditions can be viewed online on the tmcentrum.nl website. By using the website www.tmcentrum.nl and making a donation there, the donor agrees to these general terms and conditions. This means that the donor agrees to all rights and obligations as expressed in these general terms and conditions.

Article 4 – Donate
1. The donation to the campaign is transferred to a collective bank account of a third-party funds foundation for the purpose of the campaign described on the tmcentrum.nl website.
2. The foundation receives the money paid by donors and keeps it reserved for the duration of the campaign until the target amount of at least 90% has been reached, and the duration of the campaign is at least 14 days.
3. The foundation will pay the donors in return when the target amount of 90% has been reached.
4. The donor has the opportunity to reclaim the donated amount within 14 days after the donation.
5. If the donor makes use of his right of withdrawal, he will report this to the foundation within the reflection period by sending an email to info@tmcentrum.nl.
6. If the 100% target amount is not reached at the end of the campaign period of 30 days, the foundation has the option to extend the campaign.
7. If the 100% target amount is not reached after 6 months, the foundation will give each donor the opportunity to reclaim the donation.

Article 5 – The agreement
The agreement is concluded at the moment of acceptance by the donor of the offer and compliance with the corresponding conditions. If the donor has accepted the offer electronically, the foundation will immediately confirm receipt of the acceptance of the offer electronically. As long as the foundation has not confirmed receipt of this acceptance, there is no agreement between the donor and the foundation. Because the agreement is concluded electronically, the foundation takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a secure web environment. If the donor can pay electronically, the foundation takes the appropriate security measures.

Article 6 Delivery and execution
The foundation will take the greatest possible care when receiving and executing orders for which a reward is given.
The place of delivery is the address that the donor has made known to the foundation.
With due observance of what is stated in article 4 of these general terms and conditions, the foundation will deliver accepted donations as soon as possible, but no earlier than 90% of the target amount and at least 14 days of the campaign’s duration. If a reward is delayed, or if a reward cannot or only partially be performed, the donor will be notified of this no later than 30 days after placing the order.

Article 7 – Complaints procedure
Complaints about the implementation of the agreement must be submitted fully and clearly described by e-mail to info@tmcentrum.nl within a reasonable time after the donor has discovered the defects. Complaints submitted to the foundation will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the foundation will reply within 14 days with a confirmation of receipt and an indication when the donor can expect a more detailed answer. The donor must in any case give the foundation 4 weeks to resolve the complaint by mutual agreement. After this period a dispute arises that is subject to the dispute settlement procedure.

Article 8 – Disputes and applicable law
Agreements between the foundation and the donor to which these general terms and conditions apply are exclusively governed by Dutch law.
